Terms of Service

These Terms of Service ("Terms") govern your use of DazzleFlow ("the Service"). By creating an account or installing our widget, you agree to these Terms. If you don't agree, don't use the Service.

1. The Service

DazzleFlow is an AI-powered conversion recovery tool. Customers install our widget on their websites; the Service captures visitor messages and behavioral signals, classifies them, and surfaces a recovery queue and suggested next moves to the customer.

2. Accounts

You must provide accurate information when registering, keep your password confidential, and notify us promptly of unauthorized access. You're responsible for all activity under your account. You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service for commercial purposes.

3. Acceptable use

You agree not to:

  • Install the widget on websites where doing so would violate applicable law or your visitors' reasonable privacy expectations.
  • Use the Service to collect or process special categories of personal data (health, biometrics, etc.) without an appropriate legal basis.
  • Reverse-engineer, scrape, or attempt to extract our models, prompts, or non-public outputs beyond what your account is entitled to.
  • Probe, scan, or test the vulnerability of the Service, or interfere with its operation.
  • Use the Service to send spam, harass visitors, or process data of EU/UK residents without giving them the notices and choices required by law.
  • Resell, sublicense, or otherwise make the Service available to third parties as your own product, except as expressly permitted in writing.

4. Customer data and your responsibilities

You retain ownership of the data you and your visitors submit through the Service ("Customer Data"). You grant DazzleFlow a worldwide, non-exclusive license to host, process, and analyze that data to operate and improve the Service for you.

You're responsible for:

  • Posting a privacy policy on your website that discloses use of DazzleFlow and the categories of data collected.
  • Obtaining the consents your jurisdiction requires for collection and processing of visitor data.
  • Honoring visitor requests to access, correct, or delete their data — including by passing them to us when needed.

If you process data of EU/UK residents, our standard Data Processing Addendum (DPA) is incorporated by reference; email us to request a signed copy.

5. AI outputs

DazzleFlow uses third-party AI models to classify visitor messages and generate recovery suggestions. AI outputs:

  • Are probabilistic. They may be inaccurate, incomplete, or contextually wrong.
  • Are not professional advice. Don't rely on them for legal, medical, financial, or other regulated decisions.
  • Should be reviewed before acting. You're responsible for what you say or send to your visitors based on our suggestions.

We don't guarantee any particular conversion rate, recovery rate, or business outcome.

6. Fees and billing

Free plans are available for evaluation. Paid plans are billed in advance on the cycle you select (monthly or annual). Fees are non-refundable except where required by law. We may adjust pricing on 30 days' notice for new billing periods. Failure to pay may result in suspension of the Service.

7. Suspension and termination

You can cancel your account at any time from the dashboard or by emailing us. We may suspend or terminate accounts that violate these Terms, that pose a security or legal risk, or for non-payment, with reasonable notice when practical. After termination, we'll delete or anonymize Customer Data within the windows described in our Privacy Policy.

8. Confidentiality

Each party will protect the other's confidential information using at least the same care it uses for its own, and will not disclose it except as needed to operate or use the Service. This obligation survives termination for three years.

9. Intellectual property

DazzleFlow, including the widget, dashboard, models, prompts, and documentation, is owned by us and protected by intellectual property law. We grant you a limited, non-exclusive, non-transferable license to use the Service for the duration of your subscription. We may use your name and logo to identify you as a customer in marketing materials unless you ask us not to in writing.

10. Warranty disclaimer

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Service will be uninterrupted, error-free, or that AI outputs will be accurate.

11. Limitation of liability

To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, even if advised of the possibility. Each party's total liability arising out of or relating to these Terms is capped at the fees paid by you to us in the 12 months preceding the event giving rise to the claim. These limits don't apply to your payment obligations or to liability that can't be limited by law.

12. Indemnification

You agree to defend and indemnify DazzleFlow against third-party claims arising from your Customer Data, your use of the Service in violation of these Terms, or your failure to obtain required consents from visitors.

13. Disputes

Before bringing any formal claim, you agree to contact us at hello@hoodazl.com and try to resolve the issue informally. We'll do the same. If a dispute can't be resolved that way, we'll work with you in good faith to choose an appropriate venue and applicable law based on where each party is located. Specific governing-law and venue terms will be set out in a future update to these Terms; until then, applicable consumer protection rights in your country of residence still apply.

14. Changes to these Terms

We may update these Terms as the product and laws evolve. Material changes will be emailed to active customers and posted on this page with a new "last updated" date. Continued use of the Service after changes take effect constitutes acceptance.
